Action Taken at February 7, 2023 Meeting

Shall the commission:
14. Authorize the executive director to sign a $5,250 license agreement with Shoestring Circus for a waterfront parking lot? There will be seven days ($750 per day) with shows, on 5/19 to 5/21 and 5/26 to 5/29 at the gravel parking lot near the pump tract and the Granary Building in the Waterfront District. (12405/Consent Agenda B) Approved 3-0

15. Approve a lease with state auditor for suite 211 in the Bellwether Building? The five-year lease is for approximately 2,412 square feet of office use beginning on 5/1/2023 and ending on 4/30/2028. The revenue for five years is $356,373. (12406/Consent Agenda C) Approved 3-0

16.  Adopt the rules, regulations and rates’ handbook for Blaine Harbor, Squalicum Harbor and the Bellingham Cruise Terminal? The handbook (Resolution 1354) was approved at the 10/4/2016 meeting, vote #168. Some of the the existing language is  clarified as housekeeping, policy changes and rate changes. Preliminary planning and design of the inner harbor renovation has begun with a consultant. The work will look at slip configuration, slip size and waiting list demand to benefit current customers and those seeking moorage. 12407/Action Item 1 (Resolution 1354-H) Approved 3-0

Action Taken at February 21, 2023 Meeting

Shall the commission:
17. Authorize the executive director to sign a $37,854 settlement agreement with AECOM Technical Services of Seattle for a fire suppression design error at the Bellingham airport? At the 6/19/2018 meeting, vote #88, a low bid of $748,164 was awarded to Wausau Equipment of New Berlin, Wisconsin, for new snow removal equipment that will operate at 10 mph faster and has a blade eight-feet wider than previous plows. At the 7/13/2021 meeting, vote #81, a $768,220 contract was awarded to AECOM Technical Services for the design, permitting and bidding services for a building to house the snow removal equipment. At the 4/19/2022 meeting, vote #43, a $4,827,916 contract was awarded to Boss Construction of Bellingham to construct the facility to hold the equipment. According to drawing prepared by AECOM, fire suppression water piping was to be buried at three feet. An inspection by the county fire department determined the pipe should have been buried at four feet. AECOM has accepted responsibility for the additional cost to remove and reinstall the pipe at the required level. (12436/Consent Agenda B) Approved 3-0

18. Authorize the executive director to sign a $35,172 contract (amendment #1) with DH Environmental of Seattle to manage the Environmental Compliance Assessment Program? The port began the program in 1992, when it started looking more closely at the impact of tenant operations on port properties. Approximately 125 port tenants are the subject of some form of environmental regulations. DH Environmental will conduct approximately 30 site assessments and develop site reports. The program addresses stormwater regulations related to the National Pollution Discharge Elimination System phase II municipal stormwater permit. The amended contract total is $65,172: it expires on 12/31/2023. (12437/Consent Agenda C) Approved 3-0
