Shall the commission:
152. Authorize the executive director to sign documents to close a $75,000 loan to Cirrus Cycles of Bellingham? Cirrus Cycles manufactures bicycle seatpost to isolate the body from road and trail vibrations and minor impacts. The loan will allow the company to invest in research and development, increase inventory and hire a marketing/sales manager. (7939/Action Item 1) Approved 3-0

153. Authorize the executive director to sign an agreement with the city of Blaine to replace a water main along Millholin Avenue? The port-owned road provides access to a boat launch, restrooms, wash-down facility and webhouse. The agreement will allow the port to replace approximately 400 feet of asbestos cement pipe and construct a waterfront trail in lieu of a new road surface, landscaping, sidewalk, curbs and gutters. The deadline for replacing the pipe is 7/31/2023. (7940/Action Item 2) Approved 3-0

154. Authorize the executive director to award the low bid of $540,130 to RAZZ Construction of Bellingham for phase 2 of the C Street terminal project? The second phase will demolish existing concrete slabs and do minor sit grading to isolate all stormwater, install a temporary stormwater pump station to pump water into the treatment lagoon, install new water and power services and place ballast roack over the entire terminal site. Five bids were received, the high bid was $755,411. A contringency fee of $54,013 brings the total contract to $594,143. (7941/Action Item 3) Approved 3-0

155. Authorize the executive director to sign a $58,300 contract with Bennett Engineering of Bellingham to monitor the airport woodwaste landfill? Georgia-Pacific operated the landfill from 1984 to 1992; the port acquired the property in 2005. The Whatcom County Health Department issued the permit for the closure of the woodwaste landfill site in 2010, see the 12/7/2010 meeting, vote #165. It is anticipated that woodwaste post-closure monitoring, water sampling and reporting will be required for 15 to 20 years. A contingency fee of $5,830 brings the total contract to $64,130. 156. Authorize the executive director to execute 10 remedial action grant agreements with the state of Washington? At the 3/17/2015 meeting, vote #43, the commission authorized the executive director to renew nine remedial action grants with Blaine Marine Tank Farm ($587,478), central waterfront ($10,660), Cornwall Avenue landfill ($3,693,998), G-P West (1) ($6,828,948), Harris Avenue Shipyard ($13,940,000), I & J Waterway ($1,485,184), Weldcraft Steel and Marine ($872,952), Westman Marine ($896,606) and Whatcom Waterway ($2,651,770). Added to this agreement is GP West (2) Chlor 1A ($1,505,246). Funding for each site will remain unchanged with 50 percent of the cleanup eligible for reimbursement under the Model Toxics Control Act. The total amended eligible budget is $43,122,422. The terms of the the agreement are extended until 6/30/2021. (7944/Consent Agenda C) Approved 3-0

157. Adopt the 2019 strategic budget? (Public hearings held at November 6 and 20 meetings.) The regular property tax levy in 2018 will result in approximately $7,315,726 collected by the port. 7060/Action Item 1 (Resolution 1377) Approved 3-0

158. Adopt the 2019 property tax levy? (Public hearing held at November 6 meeting.) The estimated levy rate will be $.2422 per thousand of valuation. 7060/Action Item 1 (Resolution 1378) Approved 3-0

159. Set commission meetings dates for 2019? Meetings will be held on the first and third Tuesday of the month with a starting time of 4:30 p.m. Exceptions: the first Tuesday in January falls on January 1 so the meetings in January will be held on the second and fourth Tuesday and one meeting will be held on the second Tuesday in July, August and December 2019. 160. Authorize the executive director to sign $1,966,664 in contracts to implement the 2019 employee benefits program? The medical plan is $1,749150; dental and vision plan is $127,126: accidential death and dismemberment is $11,695; long term disability is $18,147; employee asistance program is $2,900 and the broker fee is $55,000. (7962/Action Item 3) Approved 3-0

161. Authorize the executive director to sign a settlement and mutual release agreement with the estate of Carl Westman for remediation costs at the Westman Marine cleanup site? From 1976 until 1989, Carl Westman owned and operated a boatyard business on approximately 1.5 areas of port property in Blaine. A 2002 report on the Westman Marine site identified the release of tributyltin; polycyclic aromatic hydrocarbons, metals and semivolatile organic compounds in sediment at the site. The site falls under the Model Toxics Control Act. Mr Westman died in 2009 and his estate was opened for probate in Whatcom County Superior Court. The estate lability is estimated to total $2.37 million. The port, the estate and Hartford Insurance Company have reached an agreement for Handford to pay the port its policy limits of $1,750,000. In exchange, the port will release all of its claims against the estate. (7963/Action Item 4) Approved 3-0

162. Authorize the executive director to sign an energy services authorization with the state of Washington for a detailed audit for the installation of solar panels at the Bellingham Cruise Terminal? At the 10/16/2018 meeting, vote #148, the commission authorized the executive director to sign an agreement with the state of Washington management services for the installation of solar panels at the cruise terminal. A preliminary audit determined that the building is suitable for the installation. Johnson Controls will conduct a detailed project design and evaluation of costs. If the project criteria cannot be met there will be no charge to the port. (7964/Action Item 5) Approved 3-0

163. Authorize the executive director to sign an agreement with the city of Bellingham for the installation, operation and maintenance of fiber conduit along portions of Roeder Avenue and C Street? Installation will be coordinated with the paving of Roeder Avenue between Whatcom Waterway and Seaview Avenue. The city of Bellingham will award the project bid on 12/10/2018. The port will have approximately one day to review the port’s portion of the bid an accept or reject it, the estimated cost is $265,000. (7965/Action Item 6) Approved 3-0

164. Authorize the executive director to sign an agreement with the Public Utility District to develop strategic plans on intrastructure and rural broadband? The port and PUD will work collaboratively to develop a public fiber strategic plan, a master plan for Cherry Point and an infrastructure needs and gap assessment for Whatcom County. The state legislature granted ports in rural counties the authority to develop broadband networks. State grants and loans are available to develop and implement strong fiber networks. The total budget is $175,000 with the port contributing $110,000 and the PUD $65,000. The agreement run from 12/1/2018 through 12/31/2020. (7966/Action Item 7) Approved 3-0

165. Authorize the executive director to sign a $331,478 contract (amendment #1) with SP Plus Corp. of Chicago, Ill., for janitorial services at the Bellingham airport? At the 1/3/2017 meeting, vote #5, a two-year contract for $616,745 was approved. The first year of the contract was $303,815, and the second year $312,930. This one-year extension runs from 2/1/2019 to 1/31/2020 and brings the total amendment amount to $948,223. (7969/Consent Agenda C) Approved 3-0

166. Authorize the executive director to sign a $85,572 with PH Consulting of Tacoma for safety improvements at the Harris Avenue railroad crossing? The work to be a quite zone includes a survey, permitting, ADA compliance evaluation, traffic engineering and design and grant funds coordination. At the 2/6/2018 meeting, vote #26, the port receiveed a $350,000 federal grant for improvements to the crossing. A contingency fee of $17,428 brings the total contract to $104,000. (7972/Consent Agenda F) Approved 3-0

167. Small Works Roster. Contracts under $300,000 fall within the executive director’s spending authority; they only require commission notification. Airport electrical improvements/charging stations and op control center, $73,916. Squalicum storage yard/moving communication gear, $196,632. (7974/Consent Agenda G)

168. Authorize the executive director to approve a $55,486 payment to the state of Washington for aquatic lands harbor leases adjacent to the Whatcom Waterway? The state issued two leases to Georgia-Pacific for the treatment lagoon known as the Aerated Stabilization Basin. The leases are for a pipeline under Whatcom Creek to the treatment lagoon for stormwater treatment and the outfall pipe from the treatment lagoon into Bellingham Bay. The treatment lagoon is part of the Whatcom Waterway cleanup site. Since 6/30/2008 the port has been using the treatment lagoon and pipeline system to manage stormwater and industrial process water. The payment period runs from 12/1/201 through 11/30/2019. (7975/Consent Agenda I) Approved 3-0
