Action Taken at August 14, 2018 Meeting

Shall the commission:
112. Authorize the executive director to sign an agreement with the Whatcom County Library System for their “Library Liftoff” program? The two main goals of the program are: signing up more people for library cards and enabling travelers to download e-books in the airport terminal building. The services are also available for Canadian travelers through agreements with Canadian libraries. The agreement runs from 9/1/2018 through 2/28/2019 and continues on a month-to-month basis. 113. Authorize the executive director to accept a $703,363 federal grant for snow removal equipment? At the 6/5/2018 meeting, vote #88, the commission approved the expenditure of $748,163 for the purchase of snow removal equipment The grant requires a 10 percent local match. The new equipment will operate at 10 mph faster and the plow is 8 feet wider. (7765/Consent Agenda D) Approved 3-0

114. Authorize the executive director to accept a $135,000 federal grant for advanced planning and preliminary site survey for Runway 16? The runway needs to be 500 feet wide and extend 1,000 feet beyond the end of the runway. Approximately 1,770 square feet is in the I-5 right-of-way and not owned by the port and another 3,930 square feet of slope area that does not meet congressionally mandated runway standards. The port has signed an agreement the the state Department of Transportation to evalute a number of options dealing with the I-5 right-of-way. (7768/Consent Agenda E) Approved 3-0

115. Authorize the executive director to sign a $148,794 contract with Anchor QEA of Seattle to provide consulting services for the former GP treatment lagoon? Between 2005 and 2014 most of the lagoons influent was stormwater and leachate from the airport woodwaste landfill. Georgia-Pacific operated the woodwaste landfill from 1984 to 1992; the port acquired the woodwaste property in 2005. The woodwaste site was closed in 2014. At one time, the port wanted to turn the treatment lagoon into a 600 slip marina for boats larger than 40 feet but at this point that proposal appears to be dead. This contract is for stormwater inspections, field tests and reports supporting the National Pollution Discharge Elimination System and industrial stormwater permits. A contginency fee of $14,879 brings the total contract to $163,673. (7769/Consent Agenda F) Approved 3-0

116. Small Works Roster. Contracts under $300,000 fall within the executive director’s spending authority; they only require commission notification. Squalicum Harbor boat launch restriping, $3,324; sprinkler system repairs, $161,064. (7771/Consent Agenda G) Approved 3-0

117. Increase the contract with Razz Construction of Bellingham by $143,310 for district energy piping? Complicated subsurface conditions have arisen in the Granary Avenue and Laurel Street project. This vote will increase the contract from $700,136 to $843,446. (7773/Consent Agenda J) Approved 3-0

118. Increase the budget by $30,000 for the remodel of the Harbor Center Building? A bid was awarded though the Small Works Roster that allow contracts under $300,000 fall within the executive director’s spending authority. The original contract was for a remodel of public restrooms, showers and laundry room. When water damage and rot was discovered throughout the building the commission increased the budget by $50,000 to $320,000. This vote increases the budget to $353,723. (7774/Consent Agenda K) Approved 3-0

119. Authorize the executive director to spend $86,900 to purchase a belt feeder and two-axle dolly for the Bellingham Shipping Terminal? At the 9/5/2017 meeting, vote #118, the commission authorized the executive director to spend $65,595 for a grain hopper extension for organic grain and at the same meeting to spend $61,524 a month to rent stacking conveyors, a telescoping conveyor, unloading hopper, grain deck truck loaders and a switch panel from Advanced Crusher Technologies. The 20-yard semi-portable belt feeder with 48” discharge belt, hydrautic jacking legs and two axel dolly will be purchased from Advanced Crusher Technologies. (7775/Consent Agenda L) Approved 3-0

120. Authorize the executive director to sign an easement agreement and mitigation license with Cascade Natural Gas on property near Squalicum Creek? The gas company has proposed constructing a small regulator station and installing new gas utility lines with a gravel driveway near the intersection of Roeder Avenue and Squalicum Way. The project is within the city of Bellingham’s shoreline juristiction but outside the Squalicum Creek buffer. The port has maintained control over the property since approximately 1927. The gas company is required to provide habitat mitigation, to offset impacts within the stream buffer, enhance the subject property and increase the habitat function of the riparian zone in the northwestern corner of the property adjacent to Squalicum Creek. 121. Authorize the executive director to sign an enhancement license and lease agreement with Cohanim Bellwether? Building D is being constructed by Cohanim Bellwether at 20 Bellwether Way. At the 10/19/2010 meeting, vote #142, the lease was amended to change the the building from a three-story 13,000 square foot building to a two-story 10,000 square foot building and require construction to be completed by 11/1/2013. At the 6/17/2014 meeting, vote #87, construction was required to be completed by 10/31/2016. At the 8/15/2017 meeting, vote #110, construction was required to begin by 4/1/2018 and substantially completed within 18 months. As a condition to obtain the necessary permit from the city of Bellingham, the company is required to install, maintain and monitor a habitat enhancement area on the northwest side of the I&J Waterway. Once the license is terminated, the port will own all plants and other materials placed in the habitat enhancement area. (7777/Consent Agenda N) Approved 3-0

122. Authorize the executive director to sign a broadband agreement in support of state-wide collaboration regarding boardband pursuits? Seven ports are parties to the agreement; Anacortes, Bellingham, Chehalis, Ilwaco, Ridgefield, Skagit, Whitman County and Woodland. The ports are contributing funds ($120,000 this year) to support the federal lobbying efforts and collaborate on state and regional efforts for the construction of port boardband systems that are consistent, streamlined, efficient and open access systems across the state. The agreement expires on 12/31/2023. (7802/Action Item 2) Approved 3-0

123. Authorize the executive director to sign a $49,999 contract with TranTech Engineering of Bellingham for consulting services to provide a reliable power supply to the Waterfront District? This is the third phase of the project, it will extend port-owned telecommunications cable along Roeder Avenue. TranTech will provide permitting, conduit design, structural assessment and contract bid documents. A contingency fee of $10,001 brings the total contract to $60,000. (7803/Action Item 3) Approved 3-0

124. Approve a land lease with TYR Port Logistics of Corpus Christi, Texas, for eight acres of property located in the “log pond” area adjacent to the Bellingham Shipping Terminal? The Texas company is a rail terminal and logistic services operator. It will pursue the installation of a rail link between the property and the BNSF main line to set up a container freight station for the receiving and storage of loaded and empty ocean containers. If they succeed in installing the rail link the containers would be exported and imported on ocean vessels via the Bellingham Shipping Terminal. The lease will be $20,909 per month and the duration will be five years with three five-year renewal options.(7804/Action Item 4) Approved 3-0

Shall the commission:
125. Authorize the executive director to dispose of surplus logs? At the 2/6/2018 meeting, vote #24, the commission approved a lease with Ginkgo Trading (the Washington State arm of Nollen Trading, a Dutch based producer and trader of wood chips) for approximately 1 acre located in the “log pond” area. Logs were delivered to the site but Gingko did not chip them, defaulted on the lease and failed to pay $10,000 in default charges to the port. The port became the owner of 77,250 board feet of logs. The property has been leased (see vote #124) and the logs need to be removed from the site by September 1. (Resolution 1376/Consent Agenda A-2) Approved 3-0

Shall the commission:
126. Authorize the executive director to sign the Airport Concession Disadvantaged Business Enterprise Program for the Bellingham airport? The federal government requires airports with concessionaires that produce more than $200,000 in gross revenue each each year to maintain an Airport Concession Disadvantaged Business Enterprise Program. The purpose of the program is to ensure nondiscrimination in the award and administration of opportunities for concessions, create an equitable and non-discriminatory business environment and help remove barriers to the participation and opportunties for concessions. (7824/Consent Agenda B) Approved 3-0

127. Authorize the executive director to sign an agreed order (amendment #2) with the state of Washington for the Central Waterfront site? The Port of Bellingham is managing the cleanup project under an agreement with the city of Bellingham. The Central Waterfront site is being managed under the Model Toxics Control Act. The agreed order provides for the investigation, study and cleanup of the 55 acre site west of Roeder Avenue between the I&J Waterway and Whatcom Waterway.The original agreed order was approved by the commission in 2006, amendment #1 was approved at the 8/21/2012 meeting, vote #141. Amendment #1 allowed an interim action to be performed to stop the release of petroleum saturated soil and sediment from a failing bulkhead at the south end of C Street. This amendment is for the next step in the process, it will develop a draft cleanup action plan. The cleanup action plan will enable the state to select a final cleanup approach for the site. The next amendment to the agreed order will be for engineering and design. (7825/Consent Agenda C) Approved 3-0

128. Authorize the executive director to sign an $18,500 contract (amendment #2) with Coffman Engineers of Seattle to provide construction support services for fire protection systems? The company was hired to evaluate, recommend and design fire protection systems for Fairhaven Marine Industrial Park buildings 3, 5 and 6. When the piping was tested for corrosion it was determined that the piping still had at lease 25 years of life and the addition of breather valves will prevent more corrosion; this amendment adds building 1. The projected cost or replacing the sprinkler systems was $531,769.(7826/Consent Agenda D) Approved 3-0

Blaine Harbor settlement monitoring project, $299,910; port-wide paving and striping project, $110,956; install safety anchors in warehouse 1 and 2, $114,624. (7827/Consent Agenda E) Approved 3-0

130. Authorize the executive director to sign an agreement modifying conservation restriction on property at the Bellingham airport? In the 1990s, the airport runaway was extended requiring 21 acres of wetlands to be covered in fill material. A 75 acre wetland mitigation plan was approved the U.S. Army Corps of Engineers in 1994. To allow for proposed future taxiways and a blast pad the Corps approved the relocation of conservation areas A, B and D further to the west adjacent to conservation parcels required by the early 1990s permit. 131. Approve the Bellingham airport master plan? (Public hearing held.) At the 8/16/2016 meeting, vote #144, the commission approved a contract with AECOM Corp. of Seattle for a planning study to replace the 2015 airport master plan approved at the 5/19/2015 meeting, vote #76. The forecasts and projected operational activity levels for the 2015 plan were deemed outdated. The 2018 master plan identifies needed improvements on the basis of safety, capacity and demand, establishes priorities, quantifies costs, and recommends a practical plan for needed improvements. Some of the proposed projects include: replacement of airfield lighting with LED system, development of a solar energy system, relocation of a fuel farm and traffic control tower. The total cost of the master plan is approximately $500,000; federal grants will reimburse the port for 90 percent. (7020/ Action Item 1) Approved 3-0

132. Authorize the executive director to sign a $103,795 contract with Mead & Hunt of Sacramento, California, for engineering consulting services at the Bellingham airport? A $135,000 federal grant for a site survey was received at the 8/14/2018 meeting, vote #114. The northwest corner of the runway safety area does not meet FAA compliance standards. Approximately 5,000 square feet overlaps onto I-5 right-of-way. To meet compliance the port will have to acquire land from the state of Washington, import fill and grade the area. This contract is for the first phase or the 30 percent concept design of the project. The federal government will fund 90 percent of the improvement program. (7821/Action Item 2) Approved 3-0

134, Authorize the executive director to sign a $57,060 contract (amendment #2) with RMC Architects of Bellingham for design, permitting and estimating support for the Blaine Marine Industrial Area building? At the 3/20/2018 meeting, vote #40, the commission approved a $245,735 contract with RMC Architects for three projects in Blaine. Amendment #1 was for $24,390, it included a site survey, geotechnical investigations and preparations of the shoreline substantial development permit for the area building. This amendment is for the remaing design, permitting and bidding steps. Estimated construction costs for the building is $543,700. (7852/Consent Agenda C) Approved 3-0

135. Approve a terminal services agreement (amendment #5) with the state of Alaska? Bellingham has been the terminus for the Alaska ferry since 1989. The services agreement for the Alaska ferry (Alaska Marine Highway System) includes staffing for ticketing, reservations, vehicle embarking and disembarking and janitorial services for ferries. This amendment runs from 10/1/2018 through 9/30/2021. The contract will generate $202,061 the first year and increase 3 percent annually. (7854/Consent Agenda E) Approved 3-0

136. Increase the weekend booking time at the Bellingham Cruise Terminal Dome Room to 90 days? Currently, the date needs to be booked 60 days in advance of the event. The weekend rates (8 a.m. to midnight) vary from $2,400 for the upper level on Saturday during the peak season (June to December) to $900 for the dome and lounge on Friday and Sunday during the off-season (January to May). 137. Increase the budget by $74,388 for two unrelated projects at the Bellingham airport? Four electric vehicle charging stations will be installed in the main parking lot. Electrical work is needed to create an operations control center on the second floor of the passenger terminal (7866/Consent Agenda K) Approved 3-0

138. Increase the contract with Razz Construction of Bellingham by $50,000 for district energy piping? Complicated subsurface conditions are continuing in the Granary Avenue and Laurel Street project. This vote will increase the contract from $$843,446 to $993,446. Complicated subsurface conditions caused the budget to be increased by $143,310 at the 8/14/2018 meeting, vote #117. (7863/Consent Agenda L) Approved 3-0

139. Authorize the executive director to negotiate and/or sign memorandums of understanding with Dakota Creek Shellfish, Boundary Fish Company, Drayton Harbor Fishery and Walsh Marine regarding property at the Blaine Marine Industrial Area? The Blaine Marine Industrial Area is home to several fish transfer and processing facilities, a boatyard as well as the sawtooth dock and weblocker. The port has begun redeveloping the area, demolishing a building, pier and bulkhead repairs. The businesses that are signing the memorandums of understanding expressed an interest leasing property and expanding their leaseholding in the Marine Industrial Area. Properties in the area are not available but the memorandum will allow the businesses to identify the location of properties to lease, indenifying size and infrastructure needs. (7864/ Action Item 1) Approved 3-0

140. Approve a lease with The Non-GMO Project for Suite 301, Bellwether Building? First American Title Insurance Company had Suite 301 leased until 1/31/2021; the company vacated the property in April of 2017. The termination of lease required First American to pay the first two months of the Non-GMO Project’s base rent. The Non-GMO Project began in 2007 when two grocery stores created it to provide their customers with information about GMOs (genetically modified organisms). The Product Vertification Program of the non-profit organization has grown steadly since, with more than 3,000 certified brands, representating over 43,000 products. Rent for the five year lease is $755,933. Approved 3-0
