Shall the commission:

106. Authorize the sale of two vessels for the nonpayment of moorage fees? Auctions are scheduled to be held in Blaine on September 7 for a 37-foot cruiser with unpaid moorage fees of $2,173 and on September 8 in Bellingham for a 24-foot sailboat with unpaid moorage fees of $2,632. The auctions were held and neither vessel was sold. (6934/Consent Agenda B). Approved 3-0

107. Authorize the executive director to sign a $267,000 contract (amendment #26) with Aspect Consulting of Seattle to perform construction oversight and prepare an interim action report for the Waterfront District? At the 8/19/2008 meeting, vote #103, the commission authorized the first phase of the remedial investigation/feasibility study of the former Georgia-Pacific mill property. This amendment provides oversight and monitoring of the mercury soil removal required by the Washington State Department of Ecology and brings the total authorized contract to $3,735,104. (6938/Consent Agenda F) Approved 3-0

Authorize the executive director to sign a $45,350 contract (amendment #12) with Kennedy/Jenks Consultants of Federal Way for grading and resurfacing portions of the Bellingham Shipping Terminal? The initial contract for consulting services was approved at the 5/5/2014 meeting, vote #66. This amendment is for phase 2, it includes demolishing the loading bay and stormwater treatment improvements. The amendment brings the total authorized contract to $829,049. (6841/Consent Agenda I) Approved 3-0

110. Amend the lease with Cohanim Bellwether (amendment #7) for Building D at Bellwether on the Bay? At the 10/19/2010 meeting, vote #142, the lease was amended to change the the building from a three-story 13,000 square foot building to a two-story 10,000 square foot building and require construction to be completed by 11/1/2013. At the 6/17/2014 meeting, vote #87, construction was required to be completed by 10/31/2016. This amendment requires construction to begin on 4/1/2018 and substantial completion within 18 months. (6846/Action Item 2) Approved 3-0

111. Approved the travel of three port staff members to Copenhagen, Denmark? The estimate cost is $1,500 per person to participate in a masterclass in urban design. The COurban Design Collective of Copenhagen and the ScanDesign Foundation at the University of Washington are providing $3,000 per person. (6947/Action Item 3) Failed 1-2, Michael McAuley and Bobby Briscoe opposed.

112. Amend membership positions on the Bellingham International Airport Advisory Committee so they are staggered and appoint six members for three-year terms? David Sienk (Birchwood), Marti Jones (Cliffside/Marine drive), Michael Corn (Urban Growth Area), David McCluskey (City/County Business Interest), Cathryn Fairfield (Columbia) and Sue Coe (Higher Education). 6948/Action Item 4 (Resolution 1364) Approved 3-0

113. Authorize the executive director to award the low bid of $452,038 to Granite Construction of Bellingham for pavement repairs at the Bellingham airport? A recent FAA inspection found several deficiencies. There are areas of failed pavement, drainage issues and areas that serve aircraft fueling vehicles have failed. Four bids were received, the high bid was $796,502. A contingency fee of $45,962 brings the totsl contract to $498,000. (6949/Action Item 5) Approved 3-0

114. Authorize the executive director to award the low bid of $1,463,674 to Faber Construction of Bellingham for phase 2 of the Bellingham Shipping Terminal resurfacing and stormwater treatment project? The work will consist of site grading and pavement resurfacing, installing media filter drain and trench drains, repairing storm drain pipes, installing roof downspouts and demolition work. Three bids were received, the high bid was $1,809,638. A contingency fee of $146,326 brings the total contract to $1,610,000. (6950/Action Item 6) Approved 3-0

115. Authorize the executive director to award the only bid of $180,116 to Rasmussen Marine Electric of Bellingham for fendering equipment for the Bellingham Shipping Terminal? The fender bladders are positioned next to Poseidon floats to hold a ship fifteen feet off the face of the pier. (6951/Action Item 7) Approved 3-0

116. Authorize the executive director to award the low bid of $1,055,912 to Engineering/Remediation Resource Group (ERRG) of Martinez, Calif. for mercury soil treatment and disposal? The Washington State Department of Ecology required the port to remove mercury impacted soil that is secured under plastic sheeting and restore pavement to isolate remaining impacts until a final cleanup is selected by ecology. Three bids were received, the high bid was $1,488,592. (6952/Action Item 8) Approved 3-0

Action Taken at September 5, 2017 Meeting

Shall the commission:

117. Authorize the executive director to award the low bid of $113,925 to American Construction of Tacoma for phase 2 of the Blaine Harbor marine structures repairs? This is the second phase of repairs to three existing piers and improvements to marina floats. Four bids were received, the high bid was $129,191. The total amended contract is $1,013,314. (6968/Action Item 1) Approved 3-0

118. Authorize the executive director to spend $65,595 for the purchase and assembly of a grain hopper extension from a sole source provider? The extension is needed at the Bellingham Shipping Terminal to accommodate shipments from Sunrise, an organic grain importer. A special extension must be manufactured to fit the opening of the hopper to receive to receive larger volumes of cargo being inserted into them and will extend over the pier. The hopper extension will be purchase from Advanced Crusher Technologies in Woodland, WA. (6970/Action Item 2) Approved 3-0

119. Authorize the executive director to sign a contract with Volaire Aviation Consulting of Fishers, Ind. to assist staff in retaining current airlines and attracting new airlines to the Bellingham airport? The consultant will assist in the development of programs and strategies to respond to changing market conditions. The contract runs from 9/15/2017 through 9/15/2020 and is limited to a total expediture of $100,000 per year. (6974/Consent Agenda B) Approved 3-0

120. Authorize the executive director to sign an easement with the city of Bellingham for Waypoint Park? The city is granted a public access easement for the installation, operation, maintenance, repair, operation and management of a park on approximately 1.67 acres along Whatcom Waterway. (6975/Consent Agenda C) Approved 3-0

122. Authorize the executive director to sign a equipment rental agreement for $61,524 (per month) with Advanced Crusher Technologies of Woodland, WA? The equipment will be stacking conveyors ($4,892), a telescoping conveyor ($23,914), unloading hopper ($16,305), grain deck truck loaders ($5,435 each) and a switch panel ($1,631). The equipment will be trucked from Longview and Woodlands to Bellingham and labor needed to assemble the equipment. Organic grain will be stored and eventally shipped out. Sunrise will bear the cost of rental, transportation and labor up to a maximum of $71,000. The equipment will also allow the loading and unloading of other bulk commodities. Rental will start on or about 9/20/2017 on a month to month basis. (6979/Action Item 3) Approved 3-0

Action Taken at September 19, 2017 Meeting

Shall the commission:

123. Modify a lease with Puglia Engineering for premises at the Harris Avenue Shipyard in Fairhaven? At the 10/1/2002 meeting, vote #95, Puglia Engineering of Bellingham signed a three-year lease for approximately 8.5 acres of property at the Bellingham Shipyard site in Fairhaven. The lease included three port-owned cranes. The Bellingham Shipyard had filed for bankruptcy. All American Marine has moved to Hilton Avenue and Puglia expressed a desire to lease the former AAM premises. The rent increases from $577,500 to $612,000 per year. The lease terminates on 10/31/2020. (6988/Action Agenda 1) Approved 3-0

124. Authorize the executive director to sign a memorandum of understanding with Air BP North America to negotiate the development a fuel farm at the Bellingham airport? Air BP is the aviation division of BP and one of the world’s largest suppliers of aviation fuel. The current fuel farm needs to be replaced due to failing infrastructure. The duration of the memorandum is twelve months. Any agreement will require commission approval. The design and construction will be paid through the collection of fees on aircraft fuel sales. (6989/Action Item 2) Approved 3-0

Action Taken at October 3, 2017 Meeting

Shall the commission:

125. Approve harbor land leases with I & J Properties for Lot A and Hilton Roeder II for Lot B? The leases are 50 year terms with one 10 year renewal option. The lessor can move marine vessels, marine equipment and other large items to and from Squalicum Harbor boat launch. The lessor can construct, manage and sublease a building on each lot. (7003/7021/Action Item 1) Approved 3-0

126. Authorize the executive director to renew the port’s liability and auto insurance coverage? The premium will be $183,096 from 10/1/2017 through 9/30/2018. Alliant Insurance Services of Newport Beach, California, will continue to serve as the broker of record. The 2016-2017 premium was $183,308. (7008/Consent Agenda B) Approved 3-0

127. Authorize the executive director to approve the facility rental rates for meetings and events? The only increase is the Squalicum Boathouse. The hourly rental for Monday through Thursday before 5 p.m. is increasing from $40 per hour to $60 per hour. (7009/Consent Agenda C) Approved 3-0

128. Adopt the revised and updated minimun standards for the Bellingham airport? The rules, regulations and minimun standards for the Bellingham airport were first adopted in 1997, with a minor addition in 1998. The airport minimum standards for aeronautical service and aviation business providers adopted on 10/3/2017 supersede the minimum standards adopted on 6/3/1997. (7011/Consent Agenda E) Approved 3-0

130. Authorize the executive director to sign a $25,000 contract (amendment #6) with Carletti Architects of Mount Vernon for construction administration support for the All American Marine manufacturing facility? When amendment #5 was approved at the 5/3/2016 meeting, vote #77, it was assumed construction would last approximately seven months. Delays due to design changes, site conditions, building code interpretations and harsh weather cause construction to take approximately 12 months. The additional money will support the closeout process. This amendment brings to total contract to $937,923. (7013/Consent Agenda G) Approved 3-0

131. Approve the 2018 Bellingham airport tariff schedule? There are increases in ground transportation service, aviation and airport user fees, rates and charges, and changes to lost/unreturned airport security badges and parking passes. The increases and changes take effect on 1/1/2018. (7014/Consent Agenda H) Approved 3-0

132. Lease all the space at 921 Cornwall Avenue to Green Truck Financial? Green Truck serves truckers in Washington, Oregon, Idaho and Montana with loans for emission-compliant trucks. It has leased office and yard space at 921 Cornwall Avenue since 1/1/2014. It wants to expand and lease all 34,000 square feet of yard space at the location. It will upgrade the yard and office space. Five-year rent for the building will be $189,000 and the yard will be $120,300. (7016/Consent Agenda D) Approved 3-0

133. Authorize the executive director to accept a $96,333 state grant for economic development services? The grant covers 7/1/2017 through 6/30/2018. The Washington State Department of Commerce (Associate Development Organization) reimburses the port for economic development services performed in Whatcom County. The state legislature created the Associate Development Organization in 1993 to support local economic development. At the 3/6/2012 meeting, vote #44, the responsibilities as the lead economic development organization in the county was transferred from the Northwest Economic Council to the Port of Bellingham. (7018/Action Item 2) Approved 3-0

134. Authorize the executive director to sign a development ready certificate with the city of Bellingham for the Granary Avenue and Laurel Street project? At the 12/3/2013 meeting, vote #176, the port commission approved the Waterfront District Master Plan. In the plan, the city and the port agreed to certain obligations for cleanup, parks, roads and infrastructure. The city has undertaken the design and permitting of Granary Avenue and Laurel Street. The park is within a Model Toxics Control Act remedial action unit and has not received a completion report from the state of Washington. This certificate assures the city that the park area does not require cleanup and the area is ready for construction. The Bellingham City Council at the 10/9/2017 meeting, vote #??, awarded the low bid of $8,710,938 to Ram Construction for the construction of the two streets. (7022/Action Item 3) Approved 3-0

Action Taken at October 17, 2017 Meeting

Shall the commission:

135. Approve the transfer of the NW Explorations lease from Brian and Carol Pemberton to Ross and Evelyn Tennant Ltd, a Canadian company? NW Exploration is a luxury yacht company with approximately 30 employees. It offers private charters, guided flotillas, maintenance/repairs and a brokerage department. At the 7/6/2004 meeting, vote #68, a lease with Grand Yachts was transferred to NW Exporations. At the 9/3/2013 meeting, vote #134, a lease was signed with NW Exploration for 1,940 square feet at the Marine Square building for a show room to display retail products and a shop area. (7027/Action Item 1) Approved 3-0

136. Authorize the executive director to sign an agreement with the city Bellingham for beach construction at Waypoint Park? At the 12/3/2013 meeting, vote #176, the port commission approved the Waterfront District Master Plan. That plan allowed construction above the ordinary high watermark, this agreement allows work at the beach area. The Bellingham City Council at the 10/9/2017 meeting, vote #168, approved a bid of $2,048,317 by Strider Construction for beach creation, playground, trail and art at the Waterfront District park. (7028/Action Item 2) Approved 3-0

136. Authorize the executive director to sign an development ready certificate with the city Bellingham for Waypoint Park? The park is within a Model Toxics Control Act remedial action unit and has not received a completion report from the state of Washington. This certificate assures the city that the park area does not require cleanup and the area is ready for construction. (7029/Action Item 3) Approved 3-0

138. Authorize the executive director to sign documents for a $75,000 loan to Tidal Vision of Ferndale? The company was created to remove ocean products from the waste stream, it has a chemical process to remove chitosan from crab shells so they are not discarded and a process to turn salmon skins into leather. The interest rate is 4 percent over 60 months. (7031/Consent Agenda B) Approved 3-0

139. Authorize the executive director to sign a $3,990 contract (amendment #10) with Moffatt & Nichols of Seattle for a mooring capacity assessment update? At the 4/21/2015 meeting, vote #62, the commission approved the initial contract with Moffatt & Nichol for pier work at the Bellingham Shipping Terminal. Since that time, phase 1 and phase 2 to upgrade and repair the mooring hardware have been completed. This amendment is for a updated report on the upgrades, a layout plan, tables and photos and brings the total contract to $445,201. (7033/Consent Agenda D) Approved 3-0

140. Authorize the auction of an aircraft for non-payment of general aviation charges? An auction will be held on 11/9/2017 for a derelict, non-flyable Mooney M20C aircraft with unpaid fees of $1,054. (7034/Action Item 4) Approved 3-0
